One of the fundamental characteristics of a revocable living trust is the ability of the settlor (the person who formed the trust) to amend or revoke the trust. This authority might, however, be delegable to other persons, depending on the circumstances. In today’s video we look at the case of In re Trust of Eva Marie Hanson, where the court of appeals clarified when an attorney in fact is allowed to amend a revocable living trust. As a bonus, we discuss some of the errors made by the court in issuing its decision and how it could be corrected.
